easytovisit.com is a registered trademark of Toots srl regulated by Italian Law, the company has offices in Milan, Venice and Pordenone. It is enrolled under the *REA* Pordenone 94014, P.IVA (VAT) 01657150932 who have sole responsibilty and ownership of all rights and related connections as set out in the following document.

Description of Service

easytovisit.com is a social travel platform that makes meetings possible between people around the world and real committed and trusted locals. easytovisit.com gives you the opportunity to experience life through travel, in a fun and engaging way, discovering places and meeting new people along the way.

easytovisit.com is a registered trademark of Toots srl, it provides this website for its customers and visitors, subject to the following Terms and Conditions. This Agreement constitutes legally binding terms and applies to your use of the Service.

Alpha Version of the Services

The Services are currently available as an alpha version. easytovisit.com is willing to allow you to use the alpha version of the Services on the condition that you abide by these Terms; you will use the Services and provide feedback to easytovisit.com regarding your use of the Services including, logging any errors, bugs or other issues related to the Services; acknowledge and agree that since the Services are in alpha, easytovisit.com makes no representations or warranties regarding the use, functionality, availability or reliability of the Services; acknowledge and agree that current features of Services may be changed, modified, cancelled partially or completely without prior notice and users data are is not guaranteed.

The version of the Services may change from time to time without prior notice to you.

Registration

In order to become a registered Friend , Traveller, Tutor, Guide or Host at easytovisit.com you are required to fill out the registration form by providing all required information. Here, at easytovisit.com, we take extra care in assuring the genuineness of all our users, therefore we follow a certification method that will allow us to guarantee that extra security for our users.

When you register with easytovisit.com as a professional you will have the authority to represent that competence legally and you will comply with all applicable laws requested by your country of residence.

Certification.

easytovisit.com is based on Profile Certification of its users.

In order to assure a safe experience all Friends and the Travellers that intend to meet them are required to certify their Identity. Certification of your identity and age will be done through an “ Instant Certification Passport” process or by uploading a valid identification document subject to verification by Toots. Until this verification process is fully completed your profile will be pending.

To process your registration as a Professional (Tutor, Guide, Host) it is necessary to forward all relevant qualifications, and documents relevant to qualify yourself as a Professional user (for example licenses, degrees, language certifications, etc) until this verification process is fully completed your profile will be pending.

You further represent and warrant that all registration information you submit is truthful and accurate and that you agree to maintain the accuracy of such information. Your account may be closed without advice and you may be barred from any future use of easytovisit.com if you provide any information that is untrue, inaccurate, not current, or incomplete, including, but not limited to, misrepresenting your age, or if easytovisit.com has reasonable reasons to suspect it.

Your account is exclusively for your personal use, and you cannot authorize others to use it, including, but not limited to, your profile. You are responsible for all content published or displayed on your member account, including e-mail messages, and your interactions with other Travellers.

easytovisit.com reserves the right to refuse or revoke an account to anyone at any time for any reason.

Users Profiles

easytovisit.com users, once fully registered, will be able to acquire different PROFILES in accordance to the level of qualification and availability they provide and the process of certification they will voluntarily undergo. It will be the sole responsibilty of the User to manage their availability. Registered and certified users will be able to apply for different profiles and therefore offer availability under different conditions to the Travellers / Users.

A *Traveller* is a registered user that may communicate/book a meeting with another registered user as a Friend, Tutor, Guide or Host.

A *Friend* is a registered and certified local that is willing to make himself available to meet Travellers for socializing and to welcome them to his town. He is not required to offer any particular skill or knowledge, just his time and hospitality FOR SOCIAL LIFE, NIGHT LIFE AND ENTERTAINMENT.

A *Tutor* is a registered, certified and skilled user that intends to offer his services to a Traveller in activities related to the place in which he lives. In order to offer his services he must be able to provide a professional CV or legal papers providing his level and field of expertise.

Tutors can offer services in different areas such as incoming activities, transport services, sport activities, gastronomy and cooking, fashion and shopping, Handicap / Ph. Challenged Services, etc.

A Guide is a registered, certified and skilled user; and is an officially licensed tourist Guide.

Usually a Guide has expertise in certain areas: cultural and historical knowledge of his country, as well as the art, architecture and literature of the area of residence.

A Host is a registered, certified and skilled user that will make himself available for hosting TravellerS in his own residence: villas, country houses, castles, B&B and any other accommodation managed by him/her and/or his/her family but that is not connected, in any way, with the categorization of hotel/motel. The Host will be required to prove that he can provide such a service under the legal system of his own country.

At any time the user may register under a new profile by completing the required registration process.

We reserve the right to limit your activities on our site if we think that such restriction will improve our security or the security of our users. We also reserve the right to cancel accounts that have been inactive for a period of time, and you confirm that you will not hold easytovisit.com responsible for any loss you will incur as a result of us taking action against your account.

Minors

All registered members must be at least 18 years old at the moment of their registration.

By registering to use our services, you declare that you are 18 or over.

Notice: Article 16 of the Law 269/98 of the Italian Law: The Italian Law “punishes with the penalty of imprisonment for crimes related to prostitution and child pornography, even if they are committed abroad.”

PNR ( Personal Number )

An 8 digit code called PNR (Personal Number) is automatically generated by the system everytime two users decide to meet and activate the meeting/booking procedure.

The code is then split in two 4 digits codes that are issued separately to the two users involved.

The main purpose of this system is to extend the security level of on-line activity and during on-site meetings. During on-site meetings each user will exchange their part of the PNR, which will then, by typing them into the meeting feedback form, be used to verify that the meeting has actually taken place and allow comments and feedback reducing the risk of fake reviews.

This system is a way to track/follow meetings allowing the user to know a bit more about other users’ experiences and to build a strong and detailed profile for others to read and value before booking decision processes.

Failure to use the PNR will automatically limit the security warranty offered and therefore any claim or complaint about the service offered will not be considered.

User Generated materials on easytovisit.com

Users are solely responsibile for the content they publish, transmit, upload, communicate or display on the website, whether posted publicly or posted privately to other users.

By posting Content on the easytovisit.com Site, you agree to and hereby do grant, and represent and warrant that you have the right to grant, easytovisit.com, its contractors, and the users of the easytovisit.com site an irrevocable, perpetual, non-exclusive (including any moral rights), royalty-free, fully sub licensable, fully paid up, worldwide license to use, reproduce, modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or sell and/or distribute such materials and/or incorporate such materials into any form, medium or technology without compensation to you. You also permit easytovisit.com to access, display, view, store and reproduce such Content for personal use. You may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights. You may not post Content that falsely express or imply that such Content or material is sponsored or endorsed by easytovisit.com.

You agree that you will only post Content that you believe to be true and you will not purposely provide false or misleading information.

Users understand and agree that easytovisit.com may review, modify or delete, without notice, any data, text, software, music, sound, message, photograph, graphic, image, video, profile, blog, journal, review, information, comment, work of authorship or other material or expression (content), whether posted publicly or posted privately to other users, that easytovisit.com has reasonable reasons to suspect the violation of the Terms and Conditions or which might be offensive, indecent or illegal or which violate the rights or threaten the safety of any person.

You may not post Contents or develop activities that:

Are false or intentionally misleading;
Infringe on any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;
Interfere with or damage our services, including, without limitation, through the use of viruses, cancel bots, Trojan horses, harmful code, flood pings, denial-of-service attacks, packet or IP spoofing, forged routing or electronic mail address information or similar methods or technology.
Are patently offensive to users of the easytovisit.com Site, such as Content or messages that promote racism, bigotry, hatred or physical harm of any kind against any group or individual;
Harass or advocate harassment of another person;
VIOLATE ANY APPLICABLE LAW OR REGULATION,
Promotes illegal activities or conduct that is abusive;

Are pornographic or sexually explicit in nature;

Users’ interaction

You are required to use the communication system provided by the easytovisit.com platform instead of other external means of communication ( email, telephone... ) to ensure you and other users with the highest level of safety both online and on-site.

You may not use the easytovisit.com platform to communicate to others in such a manner that, in the sole discretion of easytovisit.com:

Is false or intentionally misleading;
Is patently offensive and promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
Harasses or advocates harassment of another person;
Involves the transmission of unsolicited mass mailing or "spamming";
Promotes illegal activities or conduct that is abusive;
Is threatening, obscene, defamatory or libelous;
Seeks or recommends providers of material that exploits people under the age of 18 in a sexual or violent manner, or seeks or recommends providers that solicit personal information from anyone under 18

If you become aware of misuse of the Services by any person, please contact us immediately. easytovisit.com may reject, refuse to post or delete any Content for any or no reason, including, but not limited to, Content that in our sole judgment violates this Agreement or which may be offensive, illegal or violate the rights of any person or entity, or harm or threaten the safety of any person or entity. If at any time easytovisit.com chooses, in its sole discretion, to monitor the Services, easytovisit.com assumes no responsibility for the Content, no obligation to modify or remove any inappropriate Content, and no responsibility for the conduct of the User submitting any such Content. You are solely responsible for the Content that you post on, through or in connection with any of the Services, and any material or information that you transmit to other Members and for your interactions with other Users. easytovisit.com reserves the right, but has no obligation, to monitor disputes between you and other Members.

Cancellation

You can cancel your Account at any time, for any reason, unless there are ongoing meetings or bookings. In this case you must attend to your existing commitment before you can close your account, this is needed in order to safeguard and/or to not cause any damage to other members, third party or to Toots srl itself .

When you decide to cancel your account with easytovisit.com you acknowledge and expressly agree that all of your profile content, photos and other information may be irrevocably deleted.

easytovisit.com reserves the right to cancel your account at any time, for any reason or no reason, with or without prior notice or explanation and without liability.

If easytovisit.com cancels your Account because you have breached the Agreement, you shall not be entitled to the refund of any unused tokens or payments (if any).

Software

All Software, including but without limitation, all HTML code, Active X controls contained on the Site and any script within the easytovisit.com site are owned by Toots srl, its subsidiaries and / or their respective suppliers and are protected by the laws and international rules of copyright. The law expressly prohibits any other reproduction or redistribution of the Software. Violators will be prosecuted to the fullest extent permitted by applicable law. Users are not allowed to: reverse engineering, decompile or disassemble the Software, except in cases where it is expressly permitted by law.

The User acknowledges the fact that easytovisit.com is not to be held responsible of the content or conduct of linked websites. easytovisit.com reserves the right, at its sole discretion, to change, modify, add or remove these terms in whole or in part, at any time.

Governing law and choice of forum

The laws of the State of Italy (without giving effect to its conflicts of law principles) govern all matters arising out of or relating to these General Terms and Conditions of Sale, including, without limitation, their validity, interpretation, construction, performance, and enforcement. All legal proceedings arising out of or in connection with these General Terms and Conditions of Sale shall be brought solely to the City of Milan, Italy.

Severability

If any provision of these General Terms and Conditions of Sale is determined to be invalid, illegal or unenforceable, the remaining provisions of these General Terms and Conditions of Sale remain in full force to the extent permitted by law.

Changes to this Agreement or the Services

You agree and understand that these Terms of Service, the easytovisit.com website and the easytovisit.com Services may be modified by Toots srl at any time without prior notice, and such modifications will be effective upon easytovisit.com's posting of the new terms and/or upon implementation of the new changes on the easytovisit.com Site. You agree to review the Terms of Service periodically so that you are aware of any modifications. Your continued use of the easytovisit.com Service after any modification indicates your acceptance of the modified Terms of Service. Unless expressly stated otherwise by Toots srl, any new features, new services, enhancements or modifications to the easytovisit.com Service implemented after your initial access to the Service shall be subject to these Terms of Service.
